ERC pide a la Mesa que reconsidere la suspensión de los diputados presos y la acusa de extralimitarse

ERC ha difundido este sábado su escrito de petición de reconsideración dirigido a la Mesa del Congreso, a la que acusa de haberse "extralimitado" en el ejercicio de sus funciones al suspender a los cuatro diputados independentistas presos: Oriol Junqueras, Jordi Sànchez, Jordi Turull y Josep Rull.

La Mesa, presidida por la socialista Meritxell Batet, acordó el viernes suspender a los cuatro diputados presos acusados de rebelión en la causa del 'procés', una medida tomada con el aval de los letrados de la cámara, a la que sin embargo se opuso Unidas Podemos.

Junqueras, señala el escrito, "al amparo de lo establecido en el reglamento" de la Cámara Baja, "solicita la reconsideración de la decisión adoptada por la Mesa el Congreso el día 24 de mayo", para dejar "sin efecto la suspensión" de los "diputados electos en situación de prisión preventiva".

El escrito, con fecha de hoy sábado y firmado por Gabriel Rufián y el propio Junqueras, pide, además, que la presidenta del Congreso "adopte de inmediato cuantas medidas sean necesarias para salvaguardar los derechos y prerrogativas de los diputados" Oriol Junqueras, Jordi Sànchez, Jordi Turull y Josep Rull. En caso de no hacerlo, advierte ERC, "se podría estar vulnerando el derecho de participación y representación política".

ERC alega que "no sería aplicable en este caso la suspensión prevista" en el reglamento, "al no concurrir la totalidad de los elementos requeridos".

Según los republicanos, la Mesa también "se ha extralimitado en el ejercicio de las funciones que tiene encomendadas" de acuerdo con el reglamento, "al dar aplicación a una norma de naturaleza procesal sin que haya habido ninguna comunicación a la cámara por parte del órgano jurisdiccional que está conociendo el proceso".

"Se ha otorgado, pues, facultades jurisdiccionales que de ningún modo le corresponden de acuerdo con lo establecido reglamentariamente", añade el texto.

"Entendemos que no debe declararse la suspensión automática en el ejercicio del cargo por aplicarse el artículo 384 bis de la Ley de Enjuiciamiento Criminal", subraya.
